How to report copyright infringement on Prezrve, and how to respond if your content was removed.

Prezrve respects the intellectual property of creators and everyone else. We respond to clear notices of copyright infringement under the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We remove infringing material and end the accounts of repeat infringers where appropriate.
Send copyright notices and counter-notices to our designated agent:
If you believe material on Prezrve infringes a copyright you own or are authorised to act for, send our agent a written notice that includes all of the following:
We may not be able to act on a notice that's missing any of these. We may send a copy of your notice, including your name and contact details, to the person who posted the material.
When we receive a complete notice, we will:
If your material was removed and you believe it was removed by mistake or misidentification, you can send our agent a counter-notice. It must include:
The consent in item 5 is required by the DMCA. It applies only to a court action about the alleged infringement between you and the person who sent the original notice. It does not change how disputes with Prezrve are resolved under section 20 of our Terms of Service.
We'll send your counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they've filed a court action to stop the infringement, we'll restore the material within 10 to 14 business days of receiving your counter-notice.
In appropriate circumstances, we suspend or terminate the accounts of users who repeatedly infringe copyright.
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. If you're not sure whether material infringes your rights, consider speaking to a lawyer first.
Who owns or may use commissioned work (photos, videos, raw files) is set by the Booking Contract between the client and creator, and by our Terms of Service (section 11). Raise those disagreements through the booking's dispute process or with legal@prezrve.com, not through a copyright notice.
